Policy and Procedure AGREEMENT This agreement is between the real estate agent or broker (the Client) specified on the invoice and Molly Wood, Wood Home Photography (the Photographer).
PAYMENTS Full payment is due upon the delivery of photos. Travel Charge $.52 per mile past 25 mile radius from 89131. Multiple trips to the property not due to photographer error will result in a standard re-shoot fee. Payments accepted. All major credit cards, cash, check or electronic funds transfer. Required prior to download. For first-time clients, upfront payment is required at booking then for future appointments, options of payment at booking, payment on shoot site, or payment at delivery are available. Payment upon scheduling is preferred. SHOOT SCHEDULING Appointments: please leave as much detailed information as you can in notes that a team photographer may need. Available calendar time slots will be available at booking. Travel Fees, Charges and Expenses: Client is responsible for all fees and charges associated with out-of-town shoots, which is defined as travel outside 25 miles of Las Vegas. AT THE SHOOT Attendance: Either a licensed agent or the homeowner may be present for the duration of the appointment but is not required. With exception to the licensed agent, the homeowner, and the Photographer, the property is to remain vacant for the duration of the appointment. Property Condition: The property will be photographed in its condition at the photographic event time. All alterations and improvements must be made prior to the photographic event time unless discussed prior. Creation: The manner and method of creating any Photographs/ Media are solely at the discretion of Photographer and the Client has no right to control Photographer manner and method of performance under this Agreement. Photographer will use his/her best efforts to: (a) ensure that the Photos conform to Clients specifications and needs; and (b) submit all Photos to Client in publishable quality, on or before the applicable deadlines. AFTER THE SHOOT Once the images have been made, each media image will go through a multi step digital editing process and will be delivered via download link to email you specify. Images will be ready the following day (roughly 24 hours) after the shoot unless otherwise specified. Media delivery will be done in order of completed jobs. CANCELLATION, NO-SHOW AND INCLEMENT WEATHER POLICY If cancellation or re-scheduling is necessary, please do so with a minimum of a 24-hour notice. Any shoot canceled within 24 hours of a booked appointment is subject to a $100 Cancellation Fee. If the Photographer arrives at the appointment and the property is inaccessible to the Photographer, is not ready to be photographed, or the Client arrives late beyond 30 minutes to an appointment, the appointment is considered cancelled and can be billed the full rate of the shoot fee with a minimum of $100 retained. Every reasonable effort will be made to accommodate a rescheduling. In the event of inclement weather preventing photography, a new date will be scheduled at the earliest available time. RIGHTS AND USAGE All media images produced for the Client may be used by the Client for any and all marketing materials and campaigns associated with the particular property and for the Client's self-promotion. Photos are not licensed for multiple listings, nor are greater community images. The images may also be used by the Client's parent company for the sole purpose of marketing the specific property photographed. Photographer will grant a non-exclusive license to use the images upon receipt of full payment. The license covers publication and display of images in the following media: on the Internet and in print, editorial, publicity, broadcast, and display throughout the world. The license is valid in perpetuity. The license is not transferable to any third party. Copyright and ownership of the images remain with the Photographer, and the license is granted only to the Client and Clients parent company for single listing usage to include individual property marketing, and not to any third party for. Any use of the images by a third party, including, but not limited to, architects, builders, stagers, designers, sellers or buyers, is strictly prohibited unless approved in writing by the photographer before any such usage.
